Are a patient’s genetic test results available to anyone beyond that patient and his or her healthcare provider?

Myriad, as a policy, does not release genetic test results to any party other than the provider who ordered the test, or his or her designee, except as required by applicable state or federal law. Read complete HIPAA compliance information on the MGL Privacy Practices page.

What is Genetic Information?

Genetic information typically includes family history, information related to genetic services and risk assessments and genetic test results.

What protections are in place to prevent genetic discrimination?

Federal and state governments recognize the value of genetic information to patients and healthcare providers and have put specific legal protections in place to prevent genetic discrimination (the misuse of genetic information) in health insurance and employment. Can I obtain copies of my medical records maintained by Myriad?

You may review and get a copy of your protected health information (PHI) that is contained in a “designated record set” as long as we keep the PHI. A designated record set contains medical and billing records and any other records that Myriad uses to make decisions about your testing. Due to exclusions under HIPAA and clinical laboratory regulations, we cannot provide test reports directly to patients. If you need a copy of your test results, you will need to contact your healthcare provider who ordered the test. How can I limit who is able to receive copies of my medical records?

Patients may ask Myriad to limit the medical information we use or disclose for treatment, payment, or healthcare operations. Myriad is not required to agree to a restriction that you ask for, but we will carefully consider your request and tell you if we reject it. How can I find out who has received copies of my medical records?

You have the right to request a record (accounting) of when Myriad has disclosed your protected health information. This right applies to any time Myriad disclosed your PHI for purposes other than treatment, payment or healthcare operations as described in the Notice of Privacy Practices, We are not required to account for information releases that you requested, that you agreed to by signing and Authorization Form, that are given to those involved in your care, or certain other releases we are allowed to make without your permission.
